DEQ Accepting Public Comments on Proposed MATL Certificate Amendment

Helena - On August 11, 2010, Montana Tie Ltd. and MATL LLP, co-permittees for the Montana Alberta Tie Transmission Line, submitted an application to the Montana Department of Environmental Quality (DEQ) for an amendment to the Certificate of Compliance issued for the Montana portion of the 230-kV line between Great Falls and a substation near Lethbridge, Alberta.

The DEQ is accepting public comments on an Environmental Assessment (EA) prepared in response to the application for amendment. The amendment would change the language in the Certificate to allow construction activity in and within 50 ft of wetlands and would require a water quality authorization.

Due to a short statutory timeline, the DEQ must make its decision on this matter no later than September 11, 2010.

 
PSC Honors Greg Jergeson by Naming Internship Program after Him

The Public Service Commission (PSC) honored its retiring Chairman, Greg Jergeson of Chinook, by naming the Department’s new internship program after him. 
 
“Greg is a strong advocate for education, and has been for decades. He has been pushing for an internship program here at the PSC since he was elected in 2002,”observed PSC Vice Chair Ken Toole. “Now that we have a quality program up and running, naming it after Jergeson is a perfect way to officially recognize his tremendous leadership and public service.”
 
Jennifer Hill-Hart is the first Jergeson Intern. The 3rd year University of Montana Law School student is researching how other states deal with many of the complicated, and often controversial, issues related to renewable energy. Hill-Hart will summarize her findings in a memo to the Commission, including recommended actions bases on lessons learned in other states.

Stage Set for Sale of Granite County Gold Mine

LEXINGTON, Ky., -- VHGI Holdings, Inc. announced that its subsidiary, VHGI Gold, LLC, has entered into a Letter of Intent to purchase the Federal Leases and related assets to the Gold Creek Placer Mine in Granite County, Montana from GeoTerra Resources, LLC.  The purchase price is $1,500,000, of which $10,000 was paid upon signing of the Letter of Intent, and the remainder of which will be payable at the closing.

Gold Creek Placer Mine is made up of four leases: the Wisner Placer lease, the Christian Placer lease, the Pineau Placer lease and the Hughes Placer lease, which consists of 1,060 acres in the aggregate and is credited with being the location of the first verified gold strike in Montana.  In totality, according to studies undertaken by GeoTerra Resources, this mine appears to contain approximately 1.8 million cubic yards of gold bearing material that is inferred to contain in excess of 100,000 ounces of placer gold with an expected average working grade of 0.04 - 0.06 ounces of placer gold per cubic yard.

Closing of the transaction is subject to certain conditions precedent, including the execution an delivery of definitive transactions documents mutually satisfactory to the parties and satisfactory completion of due diligence by VHGI Gold.  Closing is expected to occur on or prior to August 30, 2010, subject to extension for completion of due diligence.  There can be no assurances that the closing will occur, or if it does occur, what the final terms of the transaction will be.
 
Williston Basin Interstate Pipeline Company Resolves Clean Air Act Violations

Helena --- The Montana Department of Environmental Quality (DEQ) has settled its administrative enforcement action against Williston Basin Interstate Pipeline Company (WBI) for violations of the Clean Air Act of Montana at the Baker Booster and Sandstone Creek Compressor Stations in Fallon County, Montana.

In its enforcement action, the DEQ alleged that WBI's emission test results from the April 22, 2009 compliance test indicated that the oxides of nitrogen (NOx) emissions for the Waukesha compressor engine exceeded their air quality permit limits. The company immediately shut down the engine following the compliance test. On May 1, 2009, a follow-up compliance test showed that NOx emissions were within their permit limits.

To resolve the violation, WBI paid an administrative penalty in the amount of $7,000.

 
DEQ Revokes Montana Air Quality Permits of 4 Businesses for Failure to Pay Fees

Helena --- The Montana Department of Environmental Quality (DEQ) has revoked Montana Air Quality Permits for J&J Excavating and Trucking, Inc. in Ravalli County, Bates Construction, Inc. and Crazy Mountain Rock, Inc. in Gallatin County, and Rocky Mountain Ethanol, Inc. in Sanders County.

The companies failed to pay their annual air quality operation fee for calendar year 2009 as required by the Administrative Rules of Montana and the Clean Air Act of Montana.

In May 2010, the DEQ issued a Notice of Revocation of Air Quality Permit to each of the companies. The department's revocation of the permits became final when the companies did not request a hearing before the Board of Environmental Review within 15 days after receipt of the notice.

Floatation Mill will Create up to 14 Additional Jobs

Whitehall - The Montana Department of Environmental Quality (DEQ) and the Bureau of Land Management (BLM) have approved a minor amendment to Golden Sunlight Mines, Inc. operating permit to allow for a floatation mill.

On April 13, 2010, Golden Sunlight submitted a request to the DEQ and the BLM for the flotation mill. The flotation mill will reprocess about 5,000 dry tons per day of tailings leaving the existing cyanide vat leach mill, and produce about 400 dry tons per day of fine ore product for shipment.

The permit boundary will not increase beyond the already permitted 6,125 acres. The permitted disturbance boundary of 3,101 acres will increase by one acre. The proposed increases to the permitted disturbance boundary and within the existing disturbance boundary will result from construction of new access roads and the area required for the flotation plant.

The flotation plant will be about 250 feet by 100 feet and about 80 feet tall. An access road will need to be constructed to link the plant with the Jefferson Local Development Corporation's Sunlight Business Industrial Park and then to the frontage road.
